After you’ve gone through trial and the court has ruled against you, sometimes it makes sense to file an appeal. An appeal can be filed when you believe that the judge made an error in its ruling. With an appeal you are asking a higher court to review the decision of a lower court. That sounds simple, but it’s usually not very simple.

Any appeal requires a great deal of legal research, analysis, and writing. It requires the appellant to have a handle on the issues, articulation of how the higher court has handled the same issues and similar facts in the past, and knowledge of how to use the facts and law to craft persuasive arguments. There are also time frames that the appellant must follow to ensure that certain information gets to the appellate court when it’s supposed to. After the record and briefs are filed with the higher court, an oral argument is usually held.
